Rules for the application of Decision 608 of the Andean Community of Nations

Last March, Rafael Correa Delgado, President of the Republic, subscribed the Executive Decree No. 1614, published in March 27, 2009, in Official Gazette No. 558.

The above mentioned Executive Decree establishes the application of Decision 608 of the Andean Community Commission. Taking into account that the National Congress has not yet approved the Competence Law, this Decision will be the legal framework established in the meantime in order to regulate free competence, so as to avoid prejudicial or counter-productive behavior of economic operators against it.

The rules for the application of Decision 608 of the Andean Community of Nations are based in non discrimination, transparence, and due process.

The Decision prohibits and sanctions restrictive behaviors against free competence committed in the territory of one or more member countries and with effects in one or more member countries. It also punishes anticompetitive behavior that may affect the territory of a non member country with results in two or more member countries.
