APPEAL FOR CASSATION IN THE CRIMINAL CLAIM FILED AGAINST JORGE SEVILLA QUIROZ FOR DEFAMATION
In the criminal claim for serious defamation filed by Dr. Gonzalo Guerrero Casares against Mr. Alfredo Sevilla Quiroz, the Second Criminal Division of the National Court of Justice - through ruling of January 15, 2010 - accepted the appeal for cassation based on the fact that the dispositive principle and the guarantee of due process were violated, since the complainant reported a criminal defamation, instead of serious defamation, so the verdict could not be for serious defamation.
